UAE tax residency 2026: 183 days, 90 with conditions, or no count at all

You are a UAE tax resident after 183 days in 12 consecutive months, after 90 days if you also have a right to reside and a home or job there, or with no count if your primary residence and centre of interests are in the UAE. Any part of a day counts.

Assumptions: arrival and departure days follow the country’s rule; a day in two trips counts once. How this is calculated

Track it day by day in the Taxlag app

Tax residency for individuals in the UAE rests on two short texts: Cabinet Decision No. 85 of 2022 and Ministerial Decision No. 27 of 2023, both in force since 1 March 2023. They give three routes, and you need only one. On the first, your primary residence and the centre of your financial and personal interests are in the UAE, and no day count applies. On the second, you were physically there for 183 days or more in the relevant 12 consecutive months. On the third, you were there for at least 90 days in that period and hold UAE or GCC nationality or a valid Residence Permit, and also have a permanent place of residence or carry on a job or business there. The days need not be consecutive, and parts of days count. Nothing in these routes depends on a calendar year, which is why a stay split across two years can still reach the threshold, and why this page's counter looks at your busiest 12 months.

How the UAE taxes individuals

The texts we read do not set out a scale of income tax on individuals. They approach it from the other side, through Corporate Tax. Under Cabinet Decision No. 49 of 2023, a natural person's business falls under Corporate Tax only if its total turnover goes over AED 1,000,000 in a Gregorian calendar year. Three kinds of income are not counted towards that test, whatever the amount:

Income of a natural personWhat the text says
WagesNot considered, regardless of amount
Personal investment incomeNot considered, regardless of amount
Real estate investment incomeNot considered, regardless of amount
Business turnover over AED 1,000,000Corporate Tax: 0% up to AED 375,000 of taxable income, 9% above, with registration and returns

Below that turnover, a natural person is not required to register. We word this carefully on purpose: we did not find a sentence in these official texts stating in so many words that "there is no personal income tax", so we report what the decisions do say. They deal with federal Corporate Tax and do not answer for other taxes or fees, nor for what your home country may charge you. UAE residence does not by itself end a tax liability elsewhere, as the part on former countries explains below.

The rule at a glance

Day thresholdWindowHow days countWith no day count
183rolling 12 monthsany day of presencePrimary residence and centre of interests in the UAE: resident with no day count.

Note what the table does not say: there is no minimum stay in one go, no requirement that the 12 months match the calendar year, and no need to own anything. A rented flat can be a permanent place of residence, if it is continuously available to you.

Reading the three routes closely

183 days: the simple count

Article 3 of the ministerial decision says that "day" means calendar day, "month" means calendar month, and that all days or parts of a day of physical presence count. A landing at 11 pm is a day. So is a departure at 6 am. The FTA's guide gives a worked case: in 2025, Harry spends four periods in the UAE, of 63, 63, 15 and 45 days including travel days, for a total of 186. He is a tax resident for January to December 2025. Our engine is tested against those dates and gets 186.

90 days: three conditions together

Ninety days alone do nothing. The FTA's own example is Sulaiman, who spends 100 days in hotels on tourist visas, with no job or business, and is not resident. Fatima spends 95 days, holds a Residence Permit, and has her sister's flat continuously available to her: she is resident. Saleh, a GCC national, spends 100 days working for a UAE company while living in hotels: resident too, as the job replaces the home. So you need the days, and the right to reside, and either the home or the work.

The Residence Permit in the cabinet decision excludes temporary entry permits, and a tourist visa does not fill this condition. The decision defines employment widely, with full-time or part-time work both included, but a voluntary role with no contract is not employment.

Primary residence and centre of interests: no count

Here the question is qualitative. Your usual residence is where you spend most of your time compared with any other jurisdiction, as part of a settled routine that is more than transient. Your centre of financial and personal interests is where your personal and economic interests are closest or of greatest significance; the text points to your occupation, family and social relations, cultural or other activities, place of business, and the place from which your property is administered. Both must be in the UAE. This route has no threshold, so no counter can settle it.

Days the authority can set aside

Article 4 lets the authority disregard days due to exceptional circumstances: an event beyond your control, occurring while you are already there, that you could not have predicted or prevented, and that stops you from leaving as planned. In the guide, Nicholas falls critically ill at the end of a stay and needs emergency surgery: the extra week may be excluded. Sam chooses an elective procedure in Dubai and stays on to 190 days: not exceptional, he is resident. Note the word "may": it is the authority's call, not a deduction you claim for yourself. The counter's advanced section lets you set such days aside to see the effect.

Why this counter asks for trips and not a total

The law speaks of "a relevant consecutive twelve-month period", and there are many such periods in a life with trips across two years. A total for 2026 can read 150 while the 12 months from July to June read 190. Enter your stays and the calculator finds your busiest 12 calendar months, gives the date you passed the threshold, and counts arrival and departure days as the decision does. A window of 12 calendar months is 366 days when it spans 29 February, so a fixed 365-day count can be wrong by one day, and the engine does not use one.

The certificate: fees, papers, timing

The Tax Residency Certificate is what other countries will usually want to see. You apply through the FTA's EmaraTax portal, and fees are not refunded if the application is rejected. The FTA estimates 10 business days from a complete application.

Submission fee50
Electronic certificate, natural person without a Corporate Tax number1,000
Electronic certificate, registrant with a Corporate Tax number500
Each printed copy250

The papers follow the route. For 183 days or more: Emirates ID or a passport with an entry and exit report from the Federal Authority for Identity and Citizenship or a competent local body. From 90 to 182 days: Emirates ID and passport with that report, plus proof of a job, business or permanent home. On the primary residence route: ID, passport and report, proof of your interests, of your residence and, where relevant, of your income. A certificate for use under a tax treaty also needs whatever that treaty asks for, and always the passport. The FTA says its August 2026 service card prevails in case of discrepancy, so check it before paying.

Your former country has its own say

Being resident in the UAE does not cancel your old country's rules. Cabinet Decision 85 itself says that the conditions of a tax agreement apply for that agreement. Three cases show how much this matters.

France. The France-UAE treaty has a tie-breaker in its article 4: permanent home, then centre of vital interests, then habitual abode, then nationality, then mutual agreement. But article 19(2) adds that someone resident in the UAE and domiciled for tax in France under French domestic law can be taxed in France notwithstanding the rest of the treaty, with credit for UAE tax, unless they are a UAE citizen. How that clause meets the rewritten French domicile rules is not settled in the official material we read, and we take no side. For the domestic test we rely on impots.gouv.fr and on article 4 B of the French tax code, in the version in force since 16 February 2025, read on Légifrance through an automated reading tool.

United States. Green card holders are US residents for tax purposes under the IRS test, whatever their days, and the UAE does not appear on the IRS's list of US income tax treaties when we read it. See the US page.

United Kingdom. A move to Dubai does not stop the Statutory Residence Test counting your UK midnights, and a family or a home left behind can count as ties.

The trap. People often check that they have reached the UAE thresholds, and forget to check that they have left the old country. Each one is a separate test.

Practical points before you rely on this

Ask for the official entry and exit report early, as your dates in the calculator are only your own record until the authority's report backs them up. Keep a lease or a utility contract if you rely on a permanent home, and your employment contract if you rely on work. If you approach 90 or 183 days, look at the whole 12 months around the date, not only the current calendar year. And if you only want the count kept automatically, the Taxlag app does that all year; the counter above stays free.

Questions people ask

Do I need a UAE residence visa to be a tax resident?

Not always. With 183 days or more in 12 consecutive months, the decision sets no visa condition: the test is physical presence. The FTA treats a tourist with more than 183 days as resident in its example of Sam. For the 90-day route, you do need UAE or GCC nationality or a valid Residence Permit, and temporary entry permits do not count.

Does the 183-day count in the UAE follow the calendar year?

No. The texts speak of a relevant period of 12 consecutive calendar months, not a calendar year. The certificate can be issued for a period you choose within those limits, but it cannot cover a future period or more than 12 months. So a stay from autumn to the following spring can reach 183 days without either calendar year looking heavy.

How much does a UAE tax residency certificate cost for an individual?

The FTA lists a submission fee of AED 50 and AED 1,000 for the electronic certificate of a natural person without a Corporate Tax number. A registrant with such a number pays AED 500. Each printed copy costs AED 250. Fees are not refunded if the application is rejected, and the FTA notes its current service card prevails in case of discrepancy.

Can I apply for the certificate before reaching my days?

No. The FTA says a certificate cannot cover a future period. A natural person may apply once the criteria are met for the period concerned, and the period cannot exceed 12 months. The application rests on an official entry and exit report, so an estimate of future days from a calculator is not something the authority will accept as a basis.

Do salaries count towards the AED 1,000,000 turnover test?

No. Under Cabinet Decision No. 49 of 2023, wages, personal investment income and real estate investment income are not considered in determining whether a natural person conducts a business subject to Corporate Tax, whatever their amount. Only turnover from a business or business activity counts, and the threshold applies to the total within one Gregorian calendar year.

Does a rented flat count as a permanent place of residence?

Yes, if it is continuously available to you. The ministerial decision says the place need not be owned and can be rented or otherwise occupied, provided it is furnished and you have a continuous right to occupy it, with some permanence and not just for a short stay. In the FTA guide, a sister’s flat that stays accessible meets the condition; a series of hotels does not.
